Chair of the Committee for independent institutions of the Peoples’ Majlis, Dhidhdhoo constituency MP, Ahmed Sameer has said that an extra session for the appointment of the Prosecutor General will be held when the right environment for that is created.
Sameer said that that the committee has tried to hold interviews with Ustaz Maumoon Hameed, the nomination of President Abdulla Yameen Abdul Gayoom for PG. He said that the meetings were canceled at the request of the opposition Maldivian Democratic Party (MDP) and also at the request of the government coalition.
Sameer said that the committee tried to meet President Yameen’s nominee even yesterday. He said that most of the members were found to abroad when the Majlis secretariat called all to hold the meeting.
Sameer said that he has no intention to obstruct the appointment of the Prosecutor General. He said that he wants the application of the court order of the Supreme Court to expedite the appointment of a PG.
Meanwhile, the Supreme Court recently issued a court order upon the responsible authorities to hasten to appoint the Prosecutor General without further delay.
The court order signed by the Chief Justice, Ahmed Faiz, also stated that the criminal court and all courts of law which have the jurisdiction to make decision on indictment of crime to accept cases sent by the Prosecutor General’s office although the post of the Prosecutor General remains vacant.
The Supreme Court order says that the law stipulates the responsibility of appointing the Prosecutor General upon the responsible authorities within a time frame of thirty days from the date the post becomes vacant.
The order also states that no criminal cases sent for prosecution should be taken back before the appointment of the Prosecutor General.
The former Prosecutor General Ahmed Muizz resigned on November 25th 2013. He resigned when the main opposition Maldivian Democratic Party (MDP) submitted a no confidence motion against him in the Peoples’ Majlis.
President Abdulla Yameen Abdul Gayoom proposed Maumoon Hameed as the new Prosecutor General for approval by the People’s Majlis on 10th December 2013 however the Majlis has not yet taken a decision on the nomination.
