MDP has stated that the Party was deliberating on filing charges against Elections Commission for their claim that over half of the members of MDP will be dismissed from the Party register if their fingerprints are not filed.
MDP Legal Director Hisaan Hussain stated that EC ruling was illegal and therefore would file to nullify the ruling.
Hisaan said that the Party, since its inception since 2005, had been running well within the set guidelines and regulations. However, the ruling to integrate fingerprints was instated only five years later and as such, EC cannot order the Party to find signatures for the members who had been registered in the Party prior to that.
Hisaan stated that right to political assembly was one that was granted under the Constitution and that the State cannot restrict such rights. Additionally, Hisaan said that the EC letter had quoted clause 11 of the Political Party’s Act. She pointed out that EC cannot reference to that clause as that clause was regarding the registration of political parties.
